Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pauzio AI voice-agent platform, website, and related services (the "Service") provided by Pauzio ("Pauzio", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

Pauzio lets you configure AI voice agents to place and handle phone calls — including outbound campaigns, follow-ups, reminders, and inbound handling — along with transcripts, recordings, analytics, and integrations. We may add, change, or remove features over time.

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the information in your account, for keeping your credentials secure, and for all activity that occurs under your account.

You are solely responsible for the calls you make through the Service and for the content of those calls. You agree that:

• you have obtained all necessary consents from the people you call, and you have a lawful basis to contact them;
• you will comply with all applicable laws and regulations governing calling, messaging, recording, and data — including, where applicable, TCPA, TRAI/DND, GDPR, and other telemarketing, do-not-call, and privacy rules;
• you will honor opt-out and do-not-call requests and will not use the Service for unlawful, deceptive, harassing, or fraudulent purposes; and
• you will provide any disclosures required in your jurisdiction (for example, that a call may be recorded or that the caller is an AI agent).

You will indemnify Pauzio against claims arising from calls you make or content you transmit through the Service.

You agree not to:

• use the Service to send spam, scams, or unsolicited calls in violation of law;
• impersonate others or misrepresent your identity or affiliation;
• attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its infrastructure;
• upload contact data you are not authorized to use; or
• resell or expose the Service in violation of these Terms.

We may suspend or terminate accounts that violate these Terms or that create legal or security risk.

Paid plans are billed as described on our pricing page — typically a recurring plan fee plus per-minute calling charges. Calls are billed by connected talk time, rounded up to the next whole minute. Fees are charged to your wallet or payment method on file. Except where required by law, fees are non-refundable. We may change pricing with reasonable notice.

The Service relies on third parties such as telephony carriers, speech and AI providers, and (where you enable it) Google. Your use of those integrations may be subject to their terms, and we are not responsible for third-party services. Use of data accessed through Google APIs is described in our Privacy Policy.

Pauzio and its licensors own all rights in the Service, including software, models, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the content and contact data you provide, and you grant us the rights needed to operate the Service for you.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or appropriate for every situation.

To the maximum extent permitted by law, Pauzio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months before the event giving rise to the claim.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. Upon termination, your right to use the Service ends; certain provisions (such as billing, indemnity, and liability) survive.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you through the Service. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the jurisdiction in which Pauzio is established, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction, except where applicable law provides otherwise.
